These Terms & Conditions set out the rules for using SheMarketplace Projects. Please read them carefully before publishing content, making a donation, or using the platform.
These Terms & Conditions ("Terms") govern your access to and use of SheMarketplace Projects ("the platform"). By creating an account, publishing content, making a donation, or otherwise using the platform, you agree to be bound by these Terms and by our Privacy Policy.
The platform is an online marketplace that helps project owners publish and promote community projects, funders and donors discover and support those projects, and businesses showcase their products and services.
The platform is a venue and facilitator only. Unless stated otherwise, we are not a party to any agreement between project owners, funders, donors or businesses, and we do not guarantee the outcome of any project or the accuracy of user-published content.
You must be at least 18 years old to create an account. You are responsible for keeping your login details confidential and for everything done through your account. Provide accurate information and keep your profile up to date.
We may suspend or close accounts that violate these Terms, that appear fraudulent, or that put other users or the platform at risk.
You are solely responsible for the projects, businesses, descriptions, images and other content you submit. You confirm you own or have the rights to what you publish, and you grant the platform a non-exclusive licence to host, display and promote that content in connection with the service.
You must not publish content that is unlawful, fraudulent, misleading, defamatory, discriminatory, obscene, or that infringes the rights of others, and you must not attempt to disrupt, hack or misuse the platform.
All submissions pass through moderation before publication. We may reject, unpublish or remove content at any time, with or without notice, if it breaches these Terms or if we reasonably believe it is necessary to protect users or the platform.
Donations and payments are processed by independent third-party payment providers. By donating you agree to those providers’ terms, and you acknowledge that we do not store your full card or bank details.
We are not responsible for disputes between donors and project owners. Refunds and chargebacks are handled in line with the applicable payment provider and any commitments made by the project owner. Please contact the project owner or our team at info@shemarketplace.org if you have an issue with a donation.
The platform, including its software, design, logos and branding, is owned by or licensed to us. You may not copy, resell or misuse the platform or its branding without permission.
The platform is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, we will not be liable for indirect, incidental or consequential damages arising from your use of the platform, including failed projects or unfulfilled promises by users. Nothing in these Terms limits liability that cannot be limited by law.
We may update these Terms from time to time; the “Last updated” date above reflects the current version. Continued use of the platform after changes take effect means you accept the updated Terms.
You may close your account at any time. We may restrict or terminate access to the platform if you breach these Terms.
These Terms are governed by the laws of the Republic of Kenya, and any disputes will be subject to the jurisdiction of the Kenyan courts.
